1. Acceptance of Terms

By accessing or using MyDetailAI (the "Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use the Platform. These Terms apply to all users, including registered and unregistered users, professionals, students, and enterprise clients.

We may update these Terms from time to time. Continued use of the Platform after any changes constitutes your acceptance of the updated Terms. The date of the most recent revision is shown above.

2. Nature of the Service

MyDetailAI provides AI-generated construction detail references, 3D visualisations, and building information. The Platform is designed to assist qualified professionals in understanding and visualising construction connections and details.

The Platform is not a licensed engineering or architectural service. It does not:

• Provide certified or certifiable engineering calculations
• Produce construction documentation suitable for development approval or building permit submission without professional review and sign-off
• Guarantee compliance with any building code, standard, or regulation
• Replace the professional judgement of a registered engineer, architect, or building certifier

Where the Platform references building codes or standards (including but not limited to AS 4100, NCC, AS 3600, or equivalent international standards), such references are indicative only. Code requirements change and vary by jurisdiction, project type, and specific conditions. You are responsible for verifying all code references with the current edition of the relevant standard.

3. Professional Responsibility

All outputs from MyDetailAI must be reviewed and verified by a qualified, registered professional before use in any construction project.

By using the Platform, you acknowledge and agree that:

• You are solely responsible for how you apply any information, detail, or output generated by the Platform
• The Platform does not assume the role of engineer, architect, building designer, or certifier of record on any project
• Professional sign-off and liability for any construction detail used in practice rests entirely with the licensed professional who reviews, approves, and adopts that detail
• You will not use Platform outputs as the sole basis for any structural, fire safety, waterproofing, or life-safety related construction decision
• You are responsible for ensuring that any detail used in construction complies with all applicable laws, codes, and standards in your jurisdiction

4. Limitation of Liability

To the maximum extent permitted by applicable law, MyDetailAI, its operators, directors, employees, contractors, and agents shall not be liable for any:

• Loss or damage arising from the use of, or reliance on, any content, output, or information provided by the Platform
• Structural failure, water ingress, fire, or any other construction defect or failure related to the use of Platform outputs
• Loss of profit, loss of business, or any indirect, incidental, special, or consequential loss of any kind
• Claims brought by third parties arising from your use of the Platform
• Inaccuracies in AI-generated content, including incorrect code references, incorrect dimensions, or incorrect material specifications

Where liability cannot be excluded under Australian Consumer Law or any other applicable law, our total liability is limited to the amount paid by you for the Platform in the 12 months preceding the claim, or $100 AUD, whichever is greater.

5. No Warranty

The Platform is provided "as is" and "as available" without warranty of any kind, express or implied. We do not warrant that:

• Outputs are accurate, complete, current, or error-free
• The Platform will be uninterrupted, secure, or free of errors
• Any detail generated is suitable for any particular purpose or project
• AI-generated code references reflect the current edition of any standard

6. Permitted Use

You may use the Platform for lawful purposes only. You agree not to:

• Use Platform outputs as certified or certifiable construction documentation without independent professional review
• Represent to any third party that Platform outputs carry professional endorsement or certification
• Reproduce, resell, or redistribute Platform outputs commercially without written permission
• Attempt to reverse engineer, scrape, or extract the underlying AI models or component library
• Use the Platform in any way that could expose MyDetailAI to legal liability

7. Intellectual Property

All Platform technology, including AI models, 3D component libraries, interface design, and underlying code, is the intellectual property of MyDetailAI. Nothing in these Terms grants you any ownership rights in Platform technology.

You retain ownership of the descriptions and inputs you provide to the Platform. By submitting inputs, you grant MyDetailAI a non-exclusive licence to use that input to generate your requested output and to improve the Platform's AI models.

8. AI-Generated Content

Outputs generated by the Platform are produced by artificial intelligence. AI systems can produce inaccurate, incomplete, or misleading results. You must apply professional judgement when reviewing any AI-generated output. MyDetailAI does not guarantee the accuracy of any generated detail, specification, or code reference.

Where the Platform references specific product types, fixing sizes, or material specifications, these are indicative only. Actual product selection must be confirmed with manufacturers and verified by a qualified professional for the specific project conditions.

9. Jurisdiction and Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any dispute arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of New South Wales.

If you access the Platform from outside Australia, you are responsible for compliance with local laws applicable to your use.

10. Accounts

You must provide accurate information when creating an account and keep your login credentials secure. You are responsible for all activity under your account. We may suspend or terminate accounts that breach these Terms, abuse the Platform, or attempt to circumvent usage limits.

You may delete your account at any time by contacting [email protected]. On deletion, your profile, projects, and generation history are removed from our systems.

11. Subscriptions & Billing

Paid plans (Studio and Premium) are billed monthly in Australian dollars (AUD) through our payment processor, Stripe. We do not store your card details. By subscribing you authorise recurring monthly charges until you cancel.

• Each plan includes a monthly generation and chat allowance, which resets each calendar month and does not roll over
• The free tier includes a one-time lifetime allowance of generations and does not require a card
• You can cancel, upgrade, or downgrade at any time via the billing portal in your account menu — cancellation takes effect at the end of the current billing period
• Fees already paid are non-refundable except where required by Australian Consumer Law
• We may change pricing with at least 30 days' notice; changes apply from your next billing cycle

Our collection and handling of personal information is described in our Privacy Policy, which forms part of these Terms.
